Red Flag Laws Coming To Nevada And Here’s How They Will Affect Citizens

Nevada passed red flag laws in the 2018 legislative session.

(Opinion) Being a Las Vegas native, the Route 91 attack by a coward in a hotel room hundred of yards away was devastating and sickening. However, legislators’ crocodile teared response to ban bumpstocks (a device used on semi-automatic weapons to allow rapid fire, simulating automatic fire) and incorporate red flag laws were emotionally charged measures that would have done nothing to stop this from happening.

Here is what is coming to our state: “Under the proposed red flag language of AB291, a family member or law enforcement could petition a court for a protection order against a person who they believe is a threat to themselves or to others. If the court signs off, it would prevent that person from being able to buy a gun and would require them to turn their guns into law enforcement.”

Red flag laws are laws that allow law enforcement to forcibly confiscate weapons held by an individual without due process. We would all like to prevent mass shootings and murders from deranged individuals from happening before they happen. These laws do almost nothing to prevent that and instead, yet another route for abuse and the abolishment of our 1st and 2nd amendments.

This allows an individual to report “concerning behavior” to law enforcement. What classifies as concerning behavior? Who is to say a person wont do it vindictively for what they consider hate speech but is really just an expression of their opinion? With the greatly expanded definition of hate speech, which apparantly constitutes as “triggering” messages according to this university, a mere expression of conservative ideas would render a law abiding individual stripped of their constitutional rights and means for protection.

President Trump, himself, even demonstrated an example of the abuse that will surely happen when he said Chris Cuomo’s “filthy language and total loss of control” constitutes as a reason that “he shouldnt be allowed any weapon” after his belligerent behavior went viral after being called a fictional character from the Coppola classic, “The Godfather.”

Other possible forms of abuse such as rendering a person that is intended to be harmed defenseless, turning internet arguments into police home invasions, classifying an “excessive amount of fire arms” as means to enact the law along with the concerns of vaguely described appeal processes and more show this law was poorly thought out and should be retracted immediately.

These are not wild scenarios that are made up and unlikely to happen. They are things that HAVE and WILL happen if we continue to allow feel good, unconstitutional laws into our country.
